Validation is a post-grant national step
Validation is not a new examination of the invention. It is the national post-grant step used to bring the granted European patent into effect in Turkey, subject to the applicable filing, translation and deadline requirements. We verify the patent record and required scope before accepting the instruction.
Turkey validation deadline and Turkish translation
The ordinary translation period is three months from publication of the mention of grant in the European Patent Bulletin. A further three months for the translation is available only if the publication fee and extension surcharge are paid within the initial three-month period. This is not an unconditional six-month validation deadline.
Turkey requires a Turkish translation of the patent specification, rather than a claims-only translation. Send the EP number, B1 publication, grant mention date, granted description and claims, drawings and abstract, proprietor details and any existing translations. Amendments after opposition or limitation require a separate review.
Proprietors with neither residence nor principal place of business in Turkey must appoint an authorised local representative. The proposal identifies the translation, filing and fee scope, with annuity or ownership work quoted separately.
